Former media mogul Conrad Black to be re-sentenced in June

Former media mogul Conrad Black will be re-sentenced on June 24 for the federal charges that were upheld by a federal appeals court, a US District Court judge said Thursday.

Federal prosecutors also said they would not attempt to retry Black, 66, on the charges that were overturned by the appeals court.

Black was released from a Florida prison in July following a US Supreme Court decision, which sent his case back to the lower courts to decide whether his convictions would stand.

The Supreme Court redefined a fraud statute in June, determining it only applied in cases involving bribery and kickbacks. Black’s lawyers said he would not have been convicted under the new definition of the law.

Federal prosecutors disagreed, arguing that the newly-defined law did not exonerate him. They said his 2007 convictions would be upheld because the evidence that Black and three other company executives stole more than $6.1 million still amounts to fraud.

The appeals court upheld convictions on fraud and obstruction of justice, but overturned two additional fraud charges.

Black’s lawyers are preparing to appeal to present to the US Supreme Court and asked that the sentencing be delayed until June in order to prepare their case.
