Nixzmary Brown’s brother charged with rape

Rape charges have been filed against the brother of Nixzmary Brown — the 7-year-old girl murdered in 2006 by her stepfather, Cesar Rodriguez over a cup of yogurt, law-enforcement sources said.

The 15-year-old brother was arrested and charged with rape and endangering the welfare of a minor after he allegedly sexually abused two relatives in attacks that go back to even before Nixzmary died.

Among the new revelations that investigators have discovered is that Rodriguez had told Nixzmary’s brother to have sex with a relative while he watched, sources said.

The boy’s adopted mother alerted authorities when she became aware of the sexual abuse.

The teen — who lived on Yates Avenue in The Bronx — was charged with rape and endangering the welfare of a minor. He was being held Tuesday night by cops in The Bronx. It was not clear if he would be charged as an adult.

Nixzmary’s death led to an overhaul at the city’s Administration for Children’s Services after it was revealed caseworkers had gotten reports of abuse in the family but did not act.

Rodriguez was convicted of manslaughter and sentenced to 29 years in prison.
