Cop’s killer ‘buzz’

An off-duty NYPD detective had more than 2½ times the legal limit of booze in his system even five hours after he fatally mowed down a 67-year-old Bronx woman, authorities said yesterday.

Kevin Spellman’s blood-alcohol level was 0.21 when he was finally tested after the Friday-morning accident, department spokesman Paul Browne said yesterday. The legal limit is 0.08.

Because Spellman had balked at taking a Breathalyzer test both at the scene and at the station house, investigators had to get a court order to test his blood.

As a result, his blood couldn’t be drawn until 5½ hours after the horrific incident, authorities said.

Since alcohol dissipates in the body over time, Spellman would have been much drunker than even the 0.21 reading when he struck Drana Nikac as she crossed the street in the Kingsbridge section of The Bronx at around 6:30 a.m., sources said.

Word of Spellman’s test results came as friends and relatives viewed Nikac’s body at a Bronx funeral home before it was to be taken to Albania for burial.

Other new details of the accident emerged yesterday, including evidence that Nikac had the right of way, Browne said.

A pedestrian who was crossing Kingsbridge Avenue ahead of Nikac told cops that he had a green light. He said he heard the crash behind him, suggesting that the light was green for Nikac as well.

Still, despite earlier reports that Spellman was driving at a high speed, investigators now think he was at or close to the legal limit of 30 mph.

The tragedy was the second fatal car accident in five weeks involving an allegedly drunken off-duty cop. As a result, Police Commissioner Ray Kelly said he has impaneled a commission to speed up testing of suspected drunken drivers.

On Sept. 27, off-duty cop Andrew Kelly was charged with drunken driving after he fatally mowed down a 32-year-old woman in Flatlands, Brooklyn, police said. Kelly also refused a Breathalyzer at the scene, and by the time his blood was drawn seven hours later, there was no alcohol in his system.
