Intrepid store suit

The Intrepid Museum Foundation left its gift shop high and dry after Hurricane Sandy, a new lawsuit alleges.

Owners of the shuttered souvenir store accuse the foundation of trying to boot them in favor of higher paying tenants by citing bogus storm damages.

“The foundation’s actions reflect an opportunistic money grab,” the Walsky family, which operates the store, charges in court papers.

The foundation’s president allegedly told the Walskys their space was “wholly unusable” and served them with notice for a Feb. 15 eviction.

But the family counters that the storm only caused “cosmetic” damages and that the space is completely usable.

They want the court to halt the eviction. A museum spokesperson said the lease does allow the facility to boot the store.
